Welcome to Terial Agency. These Terms and Conditions ("Terms") govern your use of our website and the services we provide. By accessing our site or engaging our services, you agree to be bound by these Terms. Please read them carefully.

1. Services

Terial Agency provides a range of digital marketing and creative services, including but not limited to: Brand PR, Visual Storytelling, UX/UI Design, Web Development, SEO Optimization, Social Media Management, and comprehensive marketing strategies as detailed on our "Our Work" and "Services" pages. The specific scope, deliverables, and timelines for any project will be formally defined in a separate Service Agreement or proposal provided to you.

2. Booking and Consultations

Our website offers the ability to book an introductory call via Calendly. This initial consultation is complimentary and intended for discovery purposes. Booking a call does not constitute a formal engagement of our services. Any subsequent work will be subject to a formal Service Agreement.

3. Pricing, Payments, and Subscriptions

3.1. Plans and Billing

We offer various subscription plans (e.g., monthly, semi-yearly, yearly) as detailed on our Pricing page. All fees are due in advance of the service period. By purchasing a subscription, you authorize us to charge your chosen payment method on a recurring basis for the agreed-upon term.

3.2. Price Changes

Terial Agency reserves the right to modify its pricing at any time. We will provide existing clients with a minimum of 30 days' notice of any changes to their subscription fees.

4. Refund Policy

Due to the nature of our creative and digital services, payments for services rendered are generally non-refundable. We are committed to client satisfaction and will make every reasonable effort to ensure the deliverables meet the agreed-upon standards outlined in the Service Agreement.

If you have concerns about a service or wish to request a refund, please contact our support team directly. All refund requests will be reviewed on a case-by-case basis. To initiate a request, please email refund@terial.agency.

5. Intellectual Property

5.1. Client Ownership

Upon receipt of full and final payment, the client will own the intellectual property rights to the final, approved deliverables as outlined in the Service Agreement. This includes finished designs, content, and website code.

5.2. Agency Portfolio Rights

Terial Agency retains the right to display and showcase the work we create for you in our portfolio, case studies, and other marketing materials, including on our "Our Work" page and social media channels.

6. Client Responsibilities

To ensure the timely and successful completion of projects, you agree to provide all necessary information, materials (e.g., brand assets, content), and feedback required by our team in a timely manner. Delays in providing these materials may result in adjustments to project timelines.

7. Limitation of Liability

Terial Agency will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising in connection with our services or these Terms. Our total liability for any claim arising out of our services will not exceed the total amount of fees paid by you to Terial Agency in the six (6) months prior to the claim.

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of our business relationship. We will not disclose your confidential information to any third party without your prior written consent, except as required by law.

9. Termination

Either party may terminate a Service Agreement with 30 days' written notice. Upon termination, the client is responsible for paying for all services rendered up to the effective termination date. Specific termination clauses and any applicable kill-fees will be detailed in the individual Service Agreement.

10. Governing Law and Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.

You agree that any legal action or proceeding between you and Terial Agency for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Kenitra, Morocco. This applies to all our clients, including those based in the USA, Europe (including France and Belgium), and other international locations.
